I request a copy of a list including the name, salary, job title, and (if available) agency or department and town of duty station for each employee of the State of Wisconsin. Either of a list prepared for calendar year 2008, fiscal year 2008, or a current list would satisfy this request. If this data in the record is easy to prepare in an accessible electronic format, I would prefer the records on CD as an excel spreadsheet, microsoft access database, text, or, as a last resort, PDF. I am requesting these records to promote government transparency, not to further a commercial interest. I hope that records of this sort are compiled routinely, and can be duplicated without great expense. I am willing to pay fees for the processing of this request up to $20. Your request requires extraction of information from the Central Payroll system which would involve programming time and costs for which we request prepayment. Our payroll data is maintained by calendar year. In order to reduce costs, we can provide data at tl1e point in time when the extract is processed including employee name, hourly pay, job classification and work addresses for the active permanent and lirnited term employees, with the exception of certain employees indicated below. Central Payroll staff estimates a total ainount of $104.57 for the » prograrnining ($75.37), administrative ($27.03) and computer downloading costs ($2.18) to compile this data in the format requested. Please be aware that the University of Wisconsin System and the State Legislature V are not on the central payroll system so we are unable to provide records for those entities. You will also need to contact the Director of State Courts to obtain any information relating to judicial branch employees. In addition, due to the pending litigation in Milwaukee Journal Sentinel, et al. v. Wis. Department of Administration, et al. (2007AP00l160), and related collective bargaining agreements, at this time we cannot provide you with the requested information for members of the bargaining unions covered by the Wisconsin State Employees Union (WSEU), Wisconsin Professional Employees Council (WPEC), Wisconsin Science Professionals (WSP) and the Wisconsin Law Enforcement Association. The aforementioned redactions could be considered a partial denial of your request. Pursuant to s. 19.35(4) (b), Stats., I am required to inform you that since your request was made in writing, the determination to deny your request in part is subject to review by mandamus under s. 19.37(l), Stats., or upon application to the attorney general or to your local district attomey. In February, I received an estimate for the fees for preparing a 2008 "copy of a list including the name, salary, job title, and (if available) agency or department and town of duty station for each employee of the State of Wisconsin" in an accessible, electronic format. You informed me that the database that you manage lacks or excludes from release data on members of the University of Wisconsin System, the State Legislature, the judicial branch, and members of certain unions. Data from a point in mid-2009 would satisfy my request. It has been more than four weeks since the estimate, and the estimate warned that my request would be closed if the Department did not hear from me by February 27. Attached is a copy of my original request. Consider it resubmitted if it must be for processing. In the case that the fees have not changed since February, enclosed is a check for $104.57 per the estimate of February 4. My apologies for the delay; I was waiting for estimates from states less prompt than Wisconsin to decide how much I am willing to pay for records. Thank you in advance for your help. For the reasons stated in my February 4, 2009, letter to you (copy enclosed), University of Wisconsin employees, State legislative employees, judicial branch employees and members of the bargaining unions covered by the Wisconsin State Employees Union (WSEU), Wisconsin Professional Employees Council (WPEC), Wisconsin Science Professionals (WSP) and the Wisconsin Law Enforcement Association are not included in the enclosed record. In addition, we redacted certain non-represented staff employed by the Department of Justice in a law enforcement investigative capacity. In balancing the interest of public disclosure against the interest of the state in protecting the identity of personnel assigned to undercover operations, we have determined that the interest in effective law enforcement investigations and the prosecution of criminal activity, along with the need to protect the personal safety of those individuals outweighs the public interest in the disclosure of those names. Pursuant to Wis. Stats. § 19.35(4) (b), I am required to inform you that the determination to partially deny your request is subject to review by mandamus under Wis.
